PRIVACY STATEMENT

This statement outlines how NIDA uses and manages personal information provided to or collected by it. The Institute is bound by the National Privacy Principles (NPPs) contained in the Commonwealth Privacy Act 1988.

What kind of personal information does the Institute collect and how does the Institute collect it?

The type of information NIDA collects and holds includes (but is not limited to) personal information, including sensitive information, about:

  • Students (full-time courses), before, during and after the duration of a student's enrolment at the Institute
  • Participants in the Open Program
  • Clients in the Corporate Training Program
  • Job applicants, staff members, volunteers and contractors; and
  • Other people who come into contact with the Institute (e.g. members of the public who purchase tickets to NIDA productions; donors and Friends of NIDA)

Personal information you provide:

The Institute will generally collect personal information held about an individual by way of forms filled out by students or parents of younger participants, face to face meetings, telephone calls, email and facsimile.

Personal information provided by other people:

In some circumstances the Institute may be provided with information about an individual from a third party, for example a report provided by a medical professional or a reference supporting a job applicant.

Exception in relation to employee records:

Under the Privacy Act the National Privacy Principles do not apply to an employee record. As a result, this does not apply to the Institute's treatment of an employee record, where the treatment is directly related to a current or former employment relationship between the Institute and employee.

How will the Institute use the personal information you provide?

The Institute will use personal information it collects from you for the primary purpose of that collection, and for such other secondary purposes that are related to the primary purpose of collection and reasonably expected, or to which you have consented.

Students, Participants and Clients:

In relation to personal information of students, participants and clients, the Institute's primary purpose of collection is to enable the Institute to provide an appropriate framework within which excellence, access and innovation can take place.

The purposes for which the Institute uses personal information of students, participants and clients include:

  • To keep students, participants and clients informed of NIDA developments, activities, etc. through newsletters and other publications
  • Day to day administration
  • Looking after students educational needs and wellbeing
  • Seeking donations and marketing for the Institute
  • To satisfy legal obligations and allow the Institute to discharge its duty of care

In some cases where the Institute requests personal information about a student, participant or client, if the information requested is not obtained, the Institute may not be able to enrol or continue the enrolment of a student.

Job applicants, staff members and contractors:

In relation to personal information of job applicants, staff members and contractors, the Institute's primary purpose of collection is to assess and (if successful) to engage the applicant, staff member or contractor, as the case may be.

The purposes for which the Institute uses personal information of job applicants, staff members and contractors include:

  • In administering the individual's employment or contract, as the case may be
  • For insurance purposes
  • Seeking funds and marketing for the Institute
  • To satisfy the Institute's legal obligations, for example in relation to child protection legislation

Volunteers:

The Institute also obtains personal information about volunteers who assist the Institute in its functions or conduct associated activities, such as the Board of Directors, Board of Studies, NIDA Foundation, Friends of NIDA to enable the Institute and the volunteers to work together.

Marketing and fundraising: The Institute treats marketing and seeking donations for the future growth and development of the Institute as an important part of ensuring that the Institute continues to be a quality environment for teaching dramatic arts in which both students and staff excel.

Personal information held by the Institute may be disclosed to the Board of Directors to assist in their fundraising activities.

Students, staff, contractors and other members of the community may from time to time receive fundraising information. NIDA publications, like promotional booklets, newsletters and fliers, which include personal information, may be used for marketing purposes.

Who might the Institute disclose personal information to?

There may be occasions in which it is necessary to disclose your personal information to third parties. The Institute may be required to do this by law, or the Institute may disclose your personal information to provide a service you have requested. Your personal information will only be disclosed where it is necessary to fulfil the purpose for which you provided the information. On no other occasions will we provide your personal information to any organisation or party outside the Institute unless we have your authority to do so.

Under no circumstances will the Institute sell or receive payment for licensing or disclosing your personal information.

Sending information overseas:

The Institute will not send information about an individual outside Australia without obtaining the consent of the individual (in some cases this consent will be implied); or otherwise complying with the National Privacy Principles.

How does the Institute treat sensitive information?

In referring to 'sensitive information', the Institute means: information relating to a person's racial or ethnic origin, political opinions, religion, trade union or other professional or trade association membership, sexual preference or criminal record, that is also personal information about an individual.

Sensitive information will be used and disclosed only for the purpose for which it was provided or a directly related secondary purpose, unless you agree otherwise, or the use or disclosure of the sensitive information is allowed by law.

Management and security of personal information

Staff are required to respect the confidentiality of students, participants and clients personal information and the privacy of individuals.

The Institute has in place steps to protect the personal information the Institute holds from misuse, loss, unauthorised access, modification or disclosure by use of various methods including locked storage of paper records and pass worded access rights to computerised records.

Updating personal information

The Institute endeavours to ensure that the personal information it holds is accurate, complete and up-to-date. A person may seek to update their personal information held by the Institute by contacting the Head of Administration at any time.

The National Privacy Principles require that personal information not be stored longer than necessary. You have the right to check what personal information the Institute holds.

Under the Commonwealth Privacy Act, an individual has the right to obtain access to any personal information, which the Institute holds, about them and to advise the Institute of any perceived inaccuracy. There are some exceptions to this right set out in the Act. Students will generally have access to their personal information.

To request access to any information the Institute holds about you please contact the Head of Administration in writing. You may be required to verify your identity and specify what information you require. The Institute may charge a fee to cover the cost of verifying your application and locating, retrieving, reviewing and copying any material requested. If the information sought is extensive, the Institute will advise the cost in advance.

Consent and rights of access to the personal information of students.

The Institute respects every students right to make decisions concerning their education at NIDA.

Students may seek access to personal information held by the Institute about them by contacting the Head of Course. However, there will be occasions when access is denied. Such occasions would include where release of the information would have an unreasonable impact on the privacy of others, or where the release may result in a breach of the Institute's duty of care to the student.

Anonymity

Where it is lawful and practicable to do so, students, participants and clients may undertake business with the Institute without providing personal information. For example, tickets to NIDA productions may be purchased in cash at the box office.
